Your response, “Pornography locking,” does not provide the legal, contractual, evidentiary, or procedural basis for the global suspension of javranking.top.

I am requesting a formal and reasoned review of this ServerHold.

Please provide:

1. The exact published .TOP Registry policy provision relied upon;
2. The specific applicable law or legally binding order relied upon;
3. Whether the action resulted from a government request, third-party complaint, blocklist, or automated monitoring;
4. The specific URLs, content, evidence, and review date supporting the decision;
5. The jurisdictional basis for applying that law to a website operated and hosted outside mainland China;
6. The appeal and reactivation procedure, including whether the sponsoring registrar may submit evidence on my behalf;
7. The reason a global ServerHold was considered necessary and proportionate.

The domain has not been alleged to engage in malware, phishing, pharming, botnet activity, or spam used to facilitate those activities. Pornographic or adult website content is not included in ICANN’s definition of DNS Abuse.

Specification 11 of the ICANN Base Registry Agreement requires a registry operator to establish, publish, and adhere to clear registration policies, and to operate the TLD transparently and consistently with principles of openness and non-discrimination.

Your own Abusive Registration Policy states that the sponsoring registrar should investigate the registration and that the domain should be returned to Live status when the registrar supplies evidence refuting the allegation or showing that the registration was not made in bad faith.

I do not admit that the domain was registered or used for malicious, abusive, or illegal activity. Please coordinate with NameSilo and provide a substantive response rather than a classification label.

If no reasoned response and appeal path are provided, I will refer the matter to ICANN Contractual Compliance as a Generic Registry Complaint.

As per ICANN’s contractual definition of DNS Abuse, it covers malware, phishing, pharming, botnet activity, and spam used to facilitate those activities. Adult/pornographic content is not classified as DNS Abuse under ICANN rules.

However, ICANN standards govern domain registration contracts globally. When domain services are provided within China, they must comply with China’s local laws and regulations on internet and domain management. Pornographic content is illegal in China. Even if it is not ICANN DNS Abuse, we are required to take actions under local regulatory requirements.

Dear .TOP Registry Compliance Team,

I understand that mainland China restricts access to pornographic content. I do not object to competent Chinese authorities preventing users located within mainland China from accessing javranking.top.

My formal objection concerns the use of a registry-level ServerHold to enforce that domestic restriction worldwide.

A ServerHold removes javranking.top from the global .TOP DNS zone. It prevents resolution not only in mainland China, but also every other jurisdiction worldwide. This is fundamentally different from restricting access within mainland China through domestic DNS blocking, network filtering, or other geographically limited measures.

I am not asking .TOP Registry to disregard Chinese regulatory requirements, nor am I asking the registry to determine which domestic technical blocking mechanism should be used. I accept that access from networks within mainland China may be restricted by the competent authorities.

However, compliance with a domestic content-access restriction does not justify disabling the domain for the rest of the world.

Javranking.top was:

• registered through an overseas ICANN-accredited registrar;
• purchased as a globally available generic top-level domain;
• operated and hosted outside mainland China;
• intended to serve users internationally.

At the time of purchase, I was not given any clear notice that content restricted within mainland China could result in the entire domain being removed from the global .TOP zone, including in jurisdictions where the service may lawfully operate.

I relied on the global availability of this domain and invested substantial time and money in development, infrastructure, branding, content preparation, search-engine indexing, and related services. The domain was then disabled worldwide without prior notice, an opportunity to respond, or a reasonable review process, causing substantial operational, reputational, traffic, and financial losses.

.TOP is a global generic top-level domain. It should not use its control of the global registry zone as a substitute for geographically limited enforcement within mainland China.

I therefore formally demand that .TOP Registry:

1. Remove the ServerHold from javranking.top;
2. Restore the domain’s nameserver delegation and normal resolution in the global .TOP DNS zone;
3. Allow users outside mainland China to continue accessing the domain normally.

Any restriction considered necessary within mainland China should be implemented or coordinated as a mainland-China access restriction. It should not be imposed by removing the domain from the global DNS for every country and every user.

If .TOP Registry refuses to remove the ServerHold, please provide a formal final decision confirming that:

1. .TOP applies mainland Chinese content restrictions to all .TOP domains worldwide;
2. .TOP considers itself entitled to disable a domain globally even where the registrant, hosting, service operation, and users are outside mainland China;
3. This worldwide restriction was clearly disclosed to registrants before purchase;
4. No geographically limited enforcement or appeal mechanism is available.

I will submit your response, the absence of prior notice, the undisclosed worldwide restriction, and the resulting losses to NameSilo and ICANN Contractual Compliance for review under the Registry Agreement requirements concerning clear registration policies, transparency, openness, and non-discrimination.

To be clear: I do not object to restricting access from mainland China. I object to .TOP Registry disabling access for the entire rest of the world.

Please remove the ServerHold and restore global DNS delegation for javranking.top.
